Terms of Sales

Article 1. Scope

These General Terms and Conditions of Sale apply to all orders placed on the website www.iniashoes.com , operated by the company TINY CORP. By validating an order, the customer acknowledges having read and accepted these General Terms and Conditions.

Article 2. Products

The products offered for sale are those which appear on the Site on the day of consultation by the Customer, within the limits of available stocks.

Each product is presented with a description of its essential characteristics and visuals. Inia. strives to represent the characteristics of the products as faithfully as possible to reality.

Article 3. Price

The prices displayed on the Site are indicated in euros, all taxes included (TTC), excluding delivery costs. Inia reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the price in effect at the time the order is validated.

Any order shipped outside of France may incur taxes and customs duties, to be paid upon arrival of the package in the destination country.

Any customs fees and taxes related to delivery are the responsibility of the customer, who assumes full liability for them. Inia. is not required to verify the amount or inform its customers of them.

Article 4. Order

Orders are placed exclusively online via the website www.iniashoes.com and are managed directly by Inia.

4.1. Order process

To place an order, the Customer must choose the product(s) of their choice, add them to the virtual basket, indicating the desired quantities and variants, and click on the “Add to basket” button.

The Customer must go to the “Basket” page and once the contents of the basket have been checked, he must click on the “Confirm my order” button.
 
The Customer must then enter their email address to log in or continue as a guest.
 
If the Client has an account, he must fill in the “password” field then click on the “connect” button.
 
If the Customer does not have an account, he/she must follow the steps provided to provide the information necessary for the order, and can choose whether or not to receive promotional offers by email and/or SMS, then click on the “order now” button.
 
The Customer must then provide a precise delivery address, as well as their personal details and click on the “validate” button.
 
Inia. is not responsible for the authenticity or accuracy of the information provided by the Client.
 
Inia. cannot be held responsible in the event of an error in the contact details provided by the Client.

The Customer must also choose one of the delivery methods among those offered.

Before clicking on the “Validate” button, the Customer has the possibility to check the details of his Order and its total price and to return to the previous pages to correct any errors or possibly modify his Order.
 
Confirmation of the Order entails acceptance of the General Terms and Conditions and formation of the contract with Inia.

Any order constitutes acceptance of the prices and items as described on the Website available for sale.

An email confirming the Order is sent by Inia to the Customer, with a summary of the order.

Inia. reserves ownership of the items until full payment of the order, i.e. receipt of the order price by Inia.
 
4.2. Modification of the order after confirmation

Any modification of information transmitted during the order process requested after confirmation thereof is subject to acceptance by Inia. which will make its best efforts to verify whether the modification is feasible and any additional costs.

4.3. Validation of the order

Inia. reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or who, in its view, presents any form of risk.

Inia. reserves the right to refuse any order for legitimate reasons and, in particular, if the quantities of products ordered are unavailable or abnormally high for buyers with consumer status.

Inia. undertakes to honor orders received on the website only within the limits of available stocks.

If one or more ordered items are unavailable, Inia. undertakes to inform the customer as soon as possible and, if necessary, to reimburse them no later than 14 days after payment of the amounts paid. The customer's order will then be automatically cancelled.

Article 5. Payment
 
5.1. Origin of payment

Metropolitan France

Payment for purchases is made at the customer's choice:

  • by bank card: Visa, MasterCard, Carte Bleue, issued in France, American Express
  • by Paypal, Apple Pay, Google Pay

5.2. Payment validation
 
Payment is validated upon receipt of the additional information requested in the case of payment by bank card requiring additional verifications. 
 
Payment of the Order by the Customer is irrevocable, subject to the right of withdrawal, and constitutes the conclusion of the sales contract with Inia.

Once payment has been made and the order has been definitively validated, an email confirming the order, indicating the products ordered and a possible delivery date will be sent to the Customer.

The order will only be considered final once Inia has sent the confirmation email, and the sale of the product(s) will only be confirmed after payment of the corresponding price.

In the event of delivery of the products and non-payment, Inia. reserves the right to claim ownership of the product(s) delivered.

Article 6. Delivery

6.1. Delivery areas

Currently, Inia. ships its products to:

6.2. Processing and shipping time

Orders placed before 1 p.m. (Paris time) from Monday to Friday are usually shipped the same day. This deadline is given for information purposes only and may not be met in the following cases:

  • Exceptional peak in activity (first day of sales, launch of collections, etc.)
  • Public holiday in France
  • Anti-fraud verification procedure on the Customer's order

The shipments are then taken care of by a transport service provider who ensures transport to the delivery address indicated by the Customer, or the parcel relay selected by the Customer.

The delivery times indicated on our website have been communicated to us by the transport service providers and are for informational purposes only. Exceeding these delivery times may under no circumstances be held against Inia., nor give rise to termination of the contract or any compensation for damages.

The risks of transport are borne by the Customer from the moment they leave the warehouse. The Customer must check the condition of the packaging and the conformity of the delivered items and immediately report any anomalies to Inia.

Goods are shipped from mainland France. If the delivery country is not part of the European Union, customs duties may be payable by the Customer.

6.3. Enhanced security during shipments

Orders are sent to the address provided by the Customer at the time of purchase. It is the Customer's responsibility to provide all necessary information to ensure smooth delivery (exact address, floor, entry code, name on the mailbox, authorized recipient, etc.).
In the event of incomplete or incorrect information, Inia. cannot be held responsible for any failure or delay in delivery.
In the event of specific requests made by the Customer directly to the carrier (such as: leaving the package in front of a door, in a mailbox, at a neighbor's or any other unsecured location), Inia. declines all responsibility in the event of loss, theft or damage to the package after its delivery.
Delivery will then be considered effective as soon as the carrier has confirmed the drop-off or delivery of the package according to the customer's instructions.

6.4. Delay in delivery

If the said items have not been delivered within 7 working days from the delivery date scheduled when ordering, and if this delay is not due to a case of force majeure or due to an event within the control of the delivery service provider (in particular in the case of an option for delivery to a relay point), the Customer may request cancellation of their order.

The amounts paid by the Customer will then be fully refunded.

6.5. Order tracking

Inia. provides its customers with order tracking.
 
The items will be considered received by the Customer as soon as delivery is confirmed by the carrier or the relay point confirms the collection of the package by the Customer.
 
In both cases, no order refund will be made by Inia.
 
Otherwise, Inia. reserves the right to assess the reality of the delivery failure before issuing a refund. Shipping costs will be deducted from the total refund amount.

The delivery of your package by the carrier is only possible upon presentation of your identity document and signature. Therefore, the carrier's tracking serves as proof of your receipt.

6.6. Verification of products upon receipt

Upon receipt of the package, the Customer is invited to check the condition and conformity of the delivered products.
Any anomaly (missing item, damaged product, open or damaged package, order error) must be reported to Inia within a maximum of 48 hours after receipt, by email or via the contact form.

After this period, no complaints will be accepted.

Article 7. Right of withdrawal

In accordance with Article L221-18 of the Consumer Code, the customer has a period of 14 calendar days from receipt of their order to exercise their right of withdrawal, without having to provide reasons or pay penalties.

To exercise this right, the Customer must notify their decision to withdraw before the expiry of the aforementioned period by email: hello@iniashoes.com

The product must be returned in its original condition, unworn, with its packaging. Return shipping costs are the responsibility of the customer.

Article 8. Reimbursement

Refunds are made within 14 days of receipt of the returned product, via the original payment method.

The customer is required to keep the proof of deposit provided by the carrier when returning their package. Inia will not issue a refund if the returned package is lost.

Article 9. Guarantees

The products benefit from legal guarantees of conformity (articles L217-4 to L217-14 of the Consumer Code) and against hidden defects (articles 1641 to 1649 of the Civil Code).

Article 10. Responsibilities

Inia. cannot be held responsible for any indirect damages that may arise from the purchase of the products.

Article 12. Applicable law

These General Terms and Conditions are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, the French courts will have sole jurisdiction.
